Mr Chew called me from Subang Jaya Medical Centre saying that his brother need to write a Will. His brother is very sick. Before I went over to see my propect client, I asked him if his brother is conscious and sound mind? The answer is "Sometime yes, sometime no". I told him that I am not able to write for his brother unless he is totally sound mind. This is prevent beneficiaries from contesting the Will in the future.

Mrs Chan is 65 years old this year. Two years ago she used her hard earned savings to buy a house and registered the house under his son's name. The reason for this is because she felt that sooner or later this house will be given to her son, thus, writing a Will is not necessary.

Last year, without her knowledge, the son sold the house used the proceeds of the sale to buy a new house and registered the new house jointly under his name and his spouse.

Mrs Chan was very angry on the sale of the house, however she can not do anything to stop the sale as the son is the legal owner of the house.

A client, Mr Chew called me yesterday saying that he need an urgent Will done for his brother who is seriously ill at a private hospital. I asked if his brother is conscious. He replied 'Yes' and his doctor can confirm that.

I rushed over to the hospital to collect some information for the Will. When I returned again, I found that his brother is not conscious, he can not open his eyes and could not wake him up.

Later when the doctor were there, the doctor said he was not conscious and he can not proceed to sign a Will.

Rockwills - Debts Cancellation Plan

I have a client by the name of Mr. Tan. He was very sick and requested me to write a Will for him.

Upon singning his Will, over the conversation, we found out that he has outstanding credit card loan of RM60,000.00 with several banks. He was told by his friends that credit card outstanding loan need not be repaid when he dies.

I explained to him that all debts must be settled before his Executor can distribute his outstanding assets as per his Will to his family members. He needs a debts cancellation plan and this can be done through purchase of a new life insurance policies and create an insurance trust or create a trust using other liquid assets.

In many occasions, we notice that there is no debts cancellation plan and the estate administration process can not continue and this cause harship to the loved ones.

What are the things we need to take note while writing a Will?

When writing a Will, it is important that the Will must be made in accordance to the Will Act 1959. Under the Act, there are some formalities to observe:-
1. The testator (person writing a Will) must be above 18 years old (For Peninsular Malaysia & Sarawak) and 21 (For Sabah)
2. The testator must be of sound mind.
3. The Will has to be attested by at least two witnesses present at the same time when the testator signs the Will.
4. A will must be in a prescribed form.
5. The beneficiaries of a Will or their spouse must not be the witness.
6. There must be a revocation clause in the Will.
7. A residuary clause to prevent partial intestacy to happen.

In a Will the testator can appoint his/her preferred Executors. The duties of the Executors are:-
• To locate the Will,
• To make funeral arrangement,
• To apply for a grant of Probate,
• To locate the assets, Pay all debts, (Trustee Act 1949)
• Prepare Statement of Accounts,
• To distribute the assets according to the Will
• To carry out the wishes mentioned in the Will.

A maximum of four Executors can be appointed in a Will. The testator can appoint them either jointly or as substitute to each other. It is recommended that two joint executors be appointed whenever there are minor beneficiaries in the Will.

It is important that we appoint an Executor that is trust worthy. A person who can carry out the estate administration duties effectively and efficiently. It will be even better if the Executor is familiar with the legal estate administration process. Traditionally, we appoint our family members to be the Executors, however, today, more and more testators are appointing trust corporation as Executors in their Wills.

A trust corporation is a better choice than an individual as an Executor. A trust corporation ensures the estate administration process is carried out professionally. Furthermore, a trust corporation enjoys perpetual succession, it never die or get sick and will not delay the administration process.

When there are minor beneficiaries named in a Will, two Trustees or a trust corporation should be appointed. Trustees are custodian of assets. It is important that we appoint Trustees we trust. The roles of Trustees are equally as important as the Executors. Some of the duties of Trustees are:-
• Continue to administer the estate where the assets can not be distributed e.g. for a minor or before the trust period ends.
• Manage the estate according to the instruction and power given by the Will and according to the Trustee Act 1949.

Normally, the Executors appointed in a Will continue to act as Trustees for minor beneficiaries.

Guardian can be appointed in a Will to take care of the welfare of the minor in the event of his/her spouse predeceased him/her or both were to go together.
It is also advisable that we should not appoint the Trustees as the Guardian. It is always wise to appoint different person to ensure there is counter-check, especially when there is money left behind for the minor children.

A beneficiary is a person who receives gifts in a Will. A beneficiary can be an individual or entity like a charity. It is important we state the name of the charity in a Will. If the charity named in a Will has ceased to operate, the Executor can donate the gift to another charity of with similar purpose.

When naming an individual as a beneficiary, it is always advisable to name a substitute beneficiary if the particular beneficiary pre-deceased us.

Apart from disposition of property, cash, shares etc, a will can also deal with other aspects e.g. funeral arrangement, terms of endearment.

The differences between an Executor and a Trustee

Many of my clients can not differentiate the difference between an Executor and a Trustee. Below are the comparison of their role.

An Executor:-
His role is to administer the estate of the testator when he passes on. Firstly he needs to apply a document known as Grant of Probate at the Court. Upon extraction of the Grant of Probate, he will locate all the assets and after payment of all debts including the funeral expenses etc, he will transfer the remaining assets of the testator according to the Will to the respective beneficiaries named therein in the Will.

His role as an Executor ends when he has finished administer the estate.

In the case where there is minor or trust invloved, he will trasnfer the assets to the Trustee named in the Will.

A Trustee:-
He will takes over any asset that need to be hold on trust from the Executor. The trust could be a statutary trust or a testamentary trust in a Will. A Trustee is just a 'guardian' of assets, he will transfer the trust asset to the respective beneficiaries when the trust ends. The assets that is held on trust by the Trustee belong to the beneficiaries not the Trustee.

Wills For Foreigners in Malaysia

Writing a simple Will is not enough? Why?

Most people will say they need a simple Will that is cheap and simple. Actually, writing a Will is not just to distribute your assets, the Will must be able to function, protect and provide liquidity when need arises in the future. These are the areas that I will consider before drafting a Will for my clients.

When there is minor, property can not be sold until all the joint owners are above 18 years old. Thus, if you just give you house to two minors equally, no sale or transfer can be done until both are above 18 years old, thus, in this scenario, it is best state clearly that Trustee has the power to sell to raise fund should need arises.

When the age gap between children are big, there is a need to create a 'Trust Fund' in the Will, this ensure the younger children are able to have enough moneys to pay for their maintenance and medical expenses through the 'Tust Fund'.

By holding back some moneys in you bank accounts in the form of a 'Trust Fund', you are indirectly protect your moneys to ensure all your children are taken care of and is fair to all your children.

Writing a Will that function is one of the most important goal we want to achive for our testator. The Will must protect the assets, ensure there is liquidity when need arises, fair to all children especially when there is minor anmed in the Will.

The Role of a Will Executor

The Executor is a person that we appoint in our Will. He is the person whom will be applying grant of probate at the Court. Upon extraction of the grant of probate, he will need to settle all debts before transfer the assets as per the Will to the beneficiaries named in the Will.

His role is an important one, thus, selection of a trustworthy Executor is vital. He must be someone who can see through the whole estate administration process and ensure the wishes of the testator is fulfilled.

I visited a client by the name of Albert few weeks ago. He is at the final stage of lung cancer, he can not talk but able to write and shown me what he wanted to put in his Will. As he is giving everything he own to his wife and appoint her as an executor. As a Will Writer I advised him to have a substitute executor and beneficiary for his Will.

A client of my by the name of Mr. Loo recently called me for an appointment to discuss his Will. Understand that Mr. Loo had previously met more than 4 Professional Will-Writers in different occasions, however he did not give his Will-Writing business to them. The reasons I gathered from him is simple, these people fall into the following scenario:-

1. Inexperience - hardly been in the business for 2 over years, yet claimed to be experience.

2. Not interest in Will business but rather try to use the appointment to sell other services like insurance, unit trust etc.

3. Not professional - the Will they suggest is not pratical. They required Mr. Loo to list down all his assets, and all this assets are given to only one person ie the wife. These Will-Writers merely trying to charge a high price (Fees based on the number of paragrapha in the Will) for the Will written. They are not Professional at all! As a Will-Writer, we should 'tailored make' the Will and write down what is necessary, pratical and useful to protect the beneficiaries, not merely trying to list down all assets unnecessary, putting down paragraphs that are not really required has no legal implication. They just want to make the Will looks longer and charge higher fees.

It is my humble advice to all Will-Writers that they should do their noble service with professional ethic, give good professional advices and be practical, otherwise you are not doing a noble service as a Will-Writer.

Finally, I managed to close Mr Loo Will at RM500.00. Cheap to many Will-Writers but to me, this is what is need by Mr. Loo, a 15 paragraph Will and I have given the best professional advice to him.

A son of my client passed on few months ago due to a heart attack. As he was single, under the Law all his assets goes to his mother who is 79 years old.

A client of mine that I met yesterday told me that, his father passed away 2 months ago. To the surprise of the family, his younger brother (Yee) producesd a Will written by his fathers dated one month before his demise, and in the Will, the father will away 100% of his estate to his younger brother(Yee)!!!

It is impossible! the father would never made such a decision and futher more, the sister who take care of the father 24 hours a day never see any lawyer come to the house to draft the Will.

After study the Will, it is highly suspected that this Will is a forge one, the brother(Yee) could have went to the lawyer firm to prepare te Will, forged the father's signature.

Now, the rest of the family is suing the validitilyof the Will, that the father is unsound mind etc.

All these happen is just because the father never plan about the distribution of his estate, it is important that we should write a Will when able and ready, do not procastinate, write a Will before it is too late.

Rockwills - To many beneficiaries to a house

A client I met yesterday said that her husband did not write a Will. He passed away recently. Now, under the Distribution Act, the 50% of the undivided share of the house that the husband own will be divided into the following manner:

1/4 of it goes to his surviving spouse
1/4 of it goes to his surviving mother
1/2 of it goes to his two surviving children in equal shares.

Understand that the mother-in-law is 'not in a very friendly' relationship with the client, thus, she might or might not write a will and will her undivided share to her grandchildren (the daughters of the deceased). More complication will arises if she die without a will in the future as the deceased has a large family, more than 8 sibilings.

The deceased can avoid all these uncertainty with a will.

A client I met yesterday told me that a friend of his has written a Will through a lawyer many years ago. This friend of his has passed away few months ago. The family realised that there is only one beneficiary named in the Will and she has passed away few years ago. As there is no substitute beneficiary named in the Will, now, the distribution now has to follow the Distribution Act.

The family was very upset that the testator was not advised properly as his wife was quiet old (70+) when the testator wrote his Will, the lawyer should have advised him to include substitute beneficiary.

Thus, it is vey mportant that there are substitute beneficiary and executor named in a Will. This ensure the Will is 100% valid underthe law.

A property under joint name

A client I met yesterday told me that his father has a house under joint name with his uncle.

Upon the father's dealth, the uncle want to claim the whole house as his father's name was put there for application of loan purposes only.

Under the distribution act, the father's half share will be given to his family while the uncle maintains his half share.

Thus, there is contention among the two families.

If the father has written a Will, he can easily will away the half share to his brother knowing that that it does not belong to the family.
